Please read these Expatlang Terms of Service carefully before using the Website and/or Services. Access and use of the Service is subject to the following Terms and Conditions of Service (“Terms and Conditions”). By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications.
You may be referred to in these Expatlang Terms as “you” or “your” or may be referred to specifically in your applicable role as a Company or an Authorized User (each as defined below). If you are entering into this Expatlang Terms on behalf of a company or other legal entity (such company or legal entity, the “Company“), these Expatlang Terms shall be a binding agreement between Expatlang and the Company that you represent, and that you have the authority to bind such Company, its users, and its affiliates to this Expatlang Terms. In that case, the terms “you” or “your” shall also refer to such entity, its users, and its affiliates, as applicable. If you do not have such authority, or if you do not agree with these Expatlang Terms, you may not use the Service. If you are entering into this Expatlang Terms as an individual and not on behalf of a company or other legal entity, this Expatlang Terms shall be a binding agreement between Expatlang and you personally. You acknowledge that these Expatlang Terms are a contract between you and Expatlang, albeit electronic, and are not physically signed by you and Expatlang, and it governs your use of the Service.

“Expatlang” a company owned by his administrator
“Expatlang website” all the domain name owned by his administrator
“Expatlang Content” means any content that Expatlang creates and makes available in connection with the Expatlang values, including proprietary Expatlang content and any content licensed or authorized for use by or through Expatlang from a third party, but excluding Member Content.
“Expatlang Product” means the Application(s) of “Expatlang“, the Site “www.expatlang.com” and any website operated by Expatlang and his administrator.
“Sites” means Expatlang’s websites, including but not limited to www.expatlang.com
“Student” means a Member that purchases Teacher Services.
“Teacher” means a Member that offers and delivers Teacher Services.
“Teacher Services” means all services delivered by Teachers as described in the Teacher Policy, including but not limited to paid lessons, packages and other services rendered where Expatlang Credits (as defined in the Refund and Payment Policy) are exchanged.
- Registration
You understand and agree that Expatlang is not a party to any agreements entered into between Students and Teachers or between Members. Expatlang has no control over the conduct of Students, Teachers, Members or other users of the Expatlang services or over any services provided by Teachers or other Members, and disclaims all liability in this regard to the maximum extent permitted by law.
- Modification
Expatlang reserves the right, at its sole discretion, to modify the Expatlang website and to modify these Expatlang Terms, at any time and without prior notice. If we modify these Expatlang Terms, we will either post the modification on the Sites and the Applications or otherwise provide you with notice of the modification. We will also update the “Last Updated” date at the top of these Expatlang Terms. By continuing to access or use the Expatlang services after we have posted a modification on the Sites and the Applications or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Expatlang Terms. If the modified Expatlang Terms are not acceptable to you, your only recourse is to cease using the Expatlang services.
- Eligibility
The Expatlang services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. Individuals under the age of 18 can use our Services only in conjunction with and under the supervision of a Parent. In this case, the Parent is responsible for all activities of the Student.
- Expatlang Services
Expatlang maintains this Website as a service to the user community that visits the Website subject to these Terms. You are responsible for obtaining and paying for any equipment and Internet service necessary to accessing our Services. We may alter, suspend, or discontinue this Website or the Services in whole or in part, at any time and for any reason, without notice. The Services may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons. We may provide access to third party services and products from time to time or to our own products or Services. You acknowledge that the Website and any mobile applications are evolving and that the form and nature of the Website or mobile applications, including the Services, may change from time to time without notice to you.
- Expatlang Account
Your Expatlang Account is for personal, non-commercial use only, provided that, if you are creating an Expatlang Account on behalf of a Company, you may authorize their Employees to use the Expatlang Platform. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current and complete.
In addition, to create an Expatlang Account, Expatlang may require you to select a username and password. You acknowledge that you shall be responsible for ensuring that any username you select does not infringe any third-party rights and is not otherwise unlawful.
You agree to notify Expatlang immediately of any unauthorized use of your Expatlang Account. We reserve the right to close your Expatlang Account at any time if you violate these Expatlang Terms or if we otherwise have a legitimate interest to do so, such as complying with a legal or regulatory obligation.
- Ownership
All content made available through Expatlang website and pages on the social media are either owned by Expatlang or Expatlang’s licensors or is licensed to Expatlang and Expatlang’s licensors pursuant to Section 8 (Member Content). As between you and Expatlang, you own your Member Content. We own the Expatlang Content, including but not limited to visual interfaces, interactive features, graphics, design, our compilation of Member Content, computer code, products, software, aggregate Member review ratings, and all other elements and components of the Expatlang website excluding Member Content. Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to the Expatlang website and the Expatlang Content are retained by Expatlang.
- Member Content
We may, in our sole discretion, permit you to post, upload, publish, submit, store or transmit your Member Content. By making available any Member Content on or through the Expatlang Platform, you hereby grant to Expatlang a worldwide, irrevocable, perpetual (or for the term of the protection), non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such Member Content on, though, by means of, or to promote or market Expatlang. Expatlang does not claim any ownership rights in any Member Content. You acknowledge and agree that you are solely responsible for all Member Content that you make available. If you are a Teacher, you may share your Member Content with your Students. Expatlang respects copyright law and expects its Members to do the same. If you believe that any content on the Expatlang website infringes copyrights you own, please notify us.
- Restrictions
We are under no obligation to enforce the Expatlang Terms on your behalf against another Member. While we encourage you to let us know if you believe another Member has violated the Expatlang Terms, we reserve the right to investigate and take appropriate action at our sole discretion.
- Links
The Expatlang website may contain links to third-party websites or resources. You acknowledge and agree that Expatlang is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by Expatlang of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources or the content, products or services on or available from such websites or resources.
- Limits
While using the Services, you agree that you will:
- Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, tax laws etc.;
- Provide accurate information to us and keep it updated;
- Use the Services and Website in a manner that is lawful, relevant and proper to the applicable laws.
- Links to third-party websites
The Website may contain links to non-EXPATLANG websites. These links are provided to You as a convenience and/or ancillary for the Services use, and EXPATLANG is not responsible for the content of any linked website. Any non-EXPATLANG website accessed from the Services is independent from EXPATLANG, and EXPATLANG has no control over the content of that website. In addition, a link to any non-EXPATLANG website does not imply that EXPATLANG endorses or accepts any responsibility for the content or use of such website. Use of any third-party website is subject to its terms of service and privacy policy. We request that our Users exercise caution and good judgment when using third-party websites.
- Suspension, Termination or Cancellation
We reserve the right to stop making available any one or more of the Expatlang services, at any time, whether on a temporary or permanent basis and without any liability, compensation, refunds or other compensatory benefits to you.
Even after your right to use the Services is terminated or suspended, these Terms will remain enforceable against you.
- Entire Agreement
Except as they may be supplemented by additional Expatlang policies, guidelines, standards, or terms for a specific product, feature, service or offering, these Expatlang Terms together with the Expatlang Policies constitute the entire and exclusive understanding and agreement between Expatlang and you pertaining to the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Expatlang and you.

II. Refund and Payment Policy (Last Updated on May 1st 2023)
PLEASE READ IT CAREFULLY BEFORE MAKING A PAYMENT AS IT DETERMINES YOUR RIGHTS
WITH REGARD TO YOUR PURCHASES, INCLUDING ESSENTIAL RESTRICTIONS AND EXCLUSIONS.
Expatlang strives to ensure a clear understanding of financial relations between students and teachers with respect to the services we provide. This policy applies to all services and features made available through the Website and any related application owned by Expatlang.
Cancellation of a session
Canceling or postponing a session without any fees is only possible up to 24h before your scheduled lesson time. Any request to cancel or postpone a session shorter than 24h beforehand can under no circumstances be refunded and the session is due.
Any session that’s completed is excluded from the legal 14-day right of withdrawal and can under no circumstances be refunded.
When purchasing a package, once the first hour is completed, the remaining hours are automatically excluded from the 14-day right of withdrawal and can under no circumstances be refunded.
We reserve the right for every teacher to charge the cost of the lesson that is cancelled less than 24 hours before its due time, without possibility of this amount being refunded to the student.
You can cancel/reschedule lessons by contacting us at finance@expatlang.com. You will be asked to provide a reason for cancellation which, in most cases, will be forwarded to your teachers.
Refund Procedure
You are required to send your refund request at finance@expatlang.com.
The refund decision shall be made up to 30 calendar days. To the fullest extent permitted by law, any refunds at any time are at our sole discretion only.
Expired balance of a learning pack
In the course of 180 (one hundred and eighty) days following the payment, your remaining balance will be considered as expired and will be irreversibly lost and nonrefundable (for 10h and 20h packs). For a 30h pack, the balance expires after 250 days,
Payment Services
We use third party payment services to bill you through an online account payment.
Correspondingly all transactions are secured as our partners-payment providers use SSL
encryption protection. All payment information is stored encrypted and securely by Stripe. For more information about their security conditions, please visit Stripe website : https://stripe.com/docs/security.
We do not store your payment information on our servers.
Data provided by you
Expatlang does not collect, store or otherwise process your billing information.
You agree that Expatlang will not be responsible for any failures of the third party to adequately protect such information. The processing of payments will be subject to the terms, conditions and privacy policies of our partners-payment providers in addition to this policy.
You acknowledge that we may change our partners-payment providers and require them to
transfer your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.
Payments and Taxes
Available payment methods through our Services are:

- PayPal
All payments shall be made through the Services.
Teachers, students and parents will be liable for all transaction fees on the services related to the delivery and consumption of services through our Website. Parties are responsible for paying all fees and applicable taxes associated with delivery and consumption of services through our Website, as well as for using the tools with a valid payment method.
Full-access to podcast resources
By selecting our full-access offer, you agree to use Services that involve an initial fee. The applicable fees for services, transaction fees, taxes and additional fees related to the purchase of the aforementioned Services is your sole responsibility and Expatlang can’t be held responsible for the payment of such fees.
To access Expatlang’s Full-Access offer you need to pay an access fee. This access fee grants access to all learning resources for Expatlang’s pocast – Understand Native French 26 conversations for an unlimited duration.
By subscribing to the Full-Access offer, you hereby acknowledge that you are aware and entitled to communicate payment details to our payment solution provider (STRIPE/PayPal). Furthermore, you are entitled to pay Expatlang’s Services by credit card, PayPal debit card, PayPal account details, or any other accepted means of payment on the date of the purchase. You authorise Expatlang to charge your credit/debit card to the above mentioned access fees as of the registration.

FREE TRIAL
Expatlang doesn’t offer any free trial for its services. However a full sample of Expatlang’s podcast resources is available with the Freemium subscription.
CANCELLATION
Subscription Services
Any subscription to Expatlang’s full-access service is non-refundable.
Any malfunction or temporary inaccessibility to resources will always be solved and cannot lead to any refund under any circumstances. For any technical issue or questions concerning general use of the website, please send a message to support@expatlang.com.
Other
Expatlang is not a bank or any type of a financial institution, we do not provide any financial services or advice. Any payments made via our website are made solely for the purpose of
consumption and delivery of educational services between students and teachers. Such payments may not be made and used for any fraudulent, criminal or illegal activity as defined by the law.
Language

III. Privacy Policy (Last Updated on 15 November 2020)
Personal data.
The information collected on our form are recorded in a computerized file by the administrator of Expatlang – Jean-Baptiste Joachim in order to respond in a personalized way to emails, to establish learning contracts, to establish invoices in relation to the services purchased on Expatlang’s website and to disseminate commercial information and promotions concerning Expatlang’s services. The legal bases of the processing are the execution of a contract and the consent.
The data are kept for a period of 5 years following the acceptance of data processing.
You can access any data related to you, change them, request their erasure or exercise your right to limit the processing of your data. You can withdraw your consent to the processing of your data at any time. You can also object to the processing of your data. You can also exercise your right to the portability of your data.
